California Payroll Taxes - New State Law, Mandatory efile of Payroll Taxes and Reports

Employers in California are required to electronically submit employment tax returns, wage reports, and payroll tax deposits to the Employment Development Department. This rule went into effect on January 1, 2017. Employers with 10 or more employees will be required to electronically file and pay.

Beginning January 1, 2018, all employers regardless of staff size will be required to electronically file and pay.

2017 Business Payroll Tax and Filing Deadlines

By January 31, 2017 - Business Payroll Tax and Filing Deadlines

Form / Deadline Description
Form 940, Employer's Annual Federal Unemployment (FUTA) Tax Return.
  • Issued to employees.
  • However, if you deposited all of the FUTA tax when due, you have 10 additional calendar days to file.
  • Filed with Internal Revenue Service (IRS).
Form 945, Annual Return of Withheld Federal Income Tax
  • To report any nonpayroll income tax withheld in the previous year.
  • If you deposited all taxes when due, you have 10 additional calendar days to file.
  • Filed with Internal Revenue Service (IRS).
W-2 (Wage & Tax Statement)
By January 31, 2017 Annual
  • Issued to employees.
  • File Copy A of all paper Forms W-2, Wage and Tax Statement, with Form W-3, Transmittal of Wage and Tax Statements, or file electronic Forms W-2.
  • Filed with Social Security Administration (SSA).
1099-MISC Forms
By January 31, 2017 Annual
  • Issued to independent contractor/ or vendors.
  • Filed with Internal Revenue Service (IRS).
